General terms and conditions

These “General Terms and Conditions” regulate the use of the Service Provider’s accommodation and services. According to the General Terms and Conditions, the operator, service provider, HOROG HOLDING Zrt., 1048. Budapest, Lóverseny tér 4. 5/14, hereinafter referred to as the Service Provider, concludes an accommodation contract with the persons and contracting parties using the accommodation service called Pát-West.

  1. Purpose of the Terms of Service
The General Terms and Conditions (GTC) contain the general terms and conditions of the legal relationship between the Service Provider and the Guest entering into a contractual relationship with him. With regard to issues not regulated here, the Hungarian laws and official regulations in force at any time concerning the activities of the Service Provider, as well as the provisions of the Civil Code shall apply without any special stipulation.
  1. Accept the Terms of Service
Acceptance of the Terms and Conditions by the Guest is a prerequisite for using the service. It is considered acceptance of the terms and conditions if the Guest uses the service provided by the Service Provider.
  1. Terms of Service
Service Provider reserves the right to amend the General Terms and Conditions in whole or in part at any time. The GTC remains in force as long as the Service Provider provides the service. These GTC are valid indefinitely from 11 November 2021.
  1. Territorial scope of the service
Service provider-operated service is available both domestically and abroad.
  1. Contract terms:
Customer / Guest: The person using the accommodation service, purchasing the service through the accommodation reservation systems and the website, who acknowledges the GTC and accepts it as obligatory, hereinafter Guest Provider: according to the terms and conditions of these GTC, the accommodation of Horog Holding Zrt., Pát-West, hereinafter referred to as the Service Provider The service : accommodation service Adult-friendly accommodation: The property wants to provide a child-friendly recreation for adults, so the minimum age of the accommodation is 14 years. Bid: The Service Provider’s written quotation for the request for quotation sent orally or in writing to the Guest. Booking: Reservation is a written confirmation of the Guest’s reservation submitted by the Service Provider, which contains the subject, place, duration and price of the service, as well as the information necessary to finalize the reservation, Details of 30% of the total cost of the accommodation. Booking finalization, validation: 30% payment as specified in the booking to secure the booking. The Booking is made after the payment of 30%, and thus qualifies as a Contract concluded in writing, and at the same time means the automatic acceptance of the GTC and the Booking and Cancellation Conditions. Payment and cancellation policy: Determining the conditions for the payment for the service provided by the Pát-West accommodation, the method and schedule of booking and payment, the case of cancellation of the booking and the non-refundable amount in case of cancellation. Accommodation services: the provision of accommodation and related services for the purpose of a non-permanent stay, including overnight stays and rest, usually in the course of a business-like economic activity. Territorial scope of the service: The service operated by the Service Provider is available both domestically and abroad.
  1. Provider provides the service under the following conditions:
6.1. Pát-West has 4 complete apartments inside a common building. The apartments open onto a common corridor. The apartments can accommodate 2-6 people and can accommodate up to 16 people. Each part of the apartment is individually heated and cooled, and is fully equipped: own kitchen with built-in refrigerator, -micro -hob, oven, kitchen equipment. The apartments can be booked individually, but can also be rented with a special offer. 6.2. The Service Provider stays at the accommodation during the day and in the afternoon, as the accommodation is located in the HorogHorses riding school. Guests, as Contracting Parties, may rent the Pát-West community room independently of the apartment and stay in the riding school in accordance with the policy. Leisure activities in the stables are possible, e.g. feathering, reading, walking, cycling, rollerblading, training contemplation along the outer and inner track, and from the common hallway through the glass wall without following the rules and disturbing the peace of others. It is possible to use equestrian leisure activities (horse riding, photography on horseback, etc.) under the guidance of the accommodation provider, using a separate service. Guests use the Patta West’s camera-guarded car park to park their car at their own risk. 6.3. We do our best to ensure the safety of our guests, we draw their attention to possible sources of danger, but we cannot be held liable for any personal property in the apartments or in the free car park, or for personal injury resulting from improper use of the riding arena or damage to the house. You will be liable for any damage you cause to the property, its machinery and equipment, or the environment. 6.4. In case of a problem, if you are staying at the Accommodation, we will be available in person, but we will be available on the website or at the telephone number or e-mail address provided in these GTC to help you during your stay. However, we are unable to accept post-departure complaints.

7. Request for quotation or booking process:

7.1. Upon the request for an offer sent orally or in writing by the Guest, the Service Provider will send a price offer. The price offer can be modified by mutual written agreement. In the absence of a response to the quote, the quote will be canceled after a grace period of 3 days. 7.2. The reservation is made after the Guest confirms the written confirmation of the submitted reservation, after the payment of 30% of the total accommodation cost, and thus qualifies as a Contract concluded in writing, and also means the automatic acceptance of the Booking and Cancellation Conditions and the ASZF. The Guest agrees that the reservation amount paid in advance by the Service Provider for the cancellation of the booking will not be refunded to the Guest. 7.3. An oral reservation, agreement, modification or its verbal confirmation by the Service Provider is not of contract value. 7.4. The content of the Agreement covers the subject matter, location, duration, price of the service, the Booking and Cancellation Conditions and the relevant ASF. 7.5. A written agreement between the parties is required to amend or supplement the Agreement. It is possible to transfer an already finalized and confirmed reservation to another date or to change the number of staff depending on the available capacity. 7.6. The Service Provider’s accommodation is free to change the announced prices, unless it undertakes no obligation for a certain period, without prior notice. 7.7. The prices include the statutory rate of value added tax (VAT), which is currently 18%. The Service Provider shall transfer the additional burdens due to the amendment of the valid Tax Act (VAT) to the Contracting Party with prior notice. 7.8. A local tourist tax is payable in addition to the accommodation fee on the basis of guest / night. Tourist tax is payable to persons between the ages of 18 and 70. 7.9. The operator of the Guest House is not responsible for the mediated services advertised on the website and in other places (active rest) and for the accidents and damages that occur during these services. The use of the advertised services is at the Customer’s own risk. 7.10. It is not possible to refund in cash the services (accommodation, mediated services) that have been booked but not used or modified during the Guest’s stay. 7.11. The contract for the use of the accommodation service is for a specified period. 7.12. If the Guest leaves the house permanently before the expiry of the specified period, the Service Provider is entitled to the full consideration for the service stipulated in the Contract. The Service Provider is entitled to resell the house vacated before the expiration date. 7.13. The prior consent of the Service Provider is required for the extension of the use of the accommodation service initiated by the Guest. In this case, the Service Provider may stipulate the reimbursement of the fee for the service already performed.
  1. Modify or delete the Service
8.1. Bid: Upon the request for an offer sent orally or in writing by the Guest, the Service Provider will send a price offer. The price offer can be modified by mutual written agreement. In the absence of a response to the quote, the quote will be canceled after a grace period of 3 days. 8.2. Reservation 8.2.1. If the 30% requested by the Service Provider to confirm the booking is not paid within 3 days, the booking will be canceled. An oral reservation, agreement, modification or its verbal confirmation by the Service Provider is not of contract value. A written agreement between the parties is required to modify or complete the booking. 8.2.2. It is possible to transfer an already finalized and confirmed reservation to another date or to change the number of staff depending on the available capacity. 8.2.3. The Service Provider is free to change the announced prices of the accommodation, unless it undertakes no obligation for a certain period, without prior notice.

9. Terms of Use:

9.1. Guests can use the property at check-in from 14:00 until 18:00 on the day of use. Check-out until 10:00 on the last day of the stay. The check-out time can be extended by prior arrangement. 9.2. Upon arrival at the accommodation, the Guest is obliged to prove his / her identity with his / her identity card before occupying the accommodation. In compliance with the legal changes of 2021, the Service Provider is obliged to read and upload the Guest ID card with the document reader or document reader software to the Guest Information Closed Database (VIZA) regardless of age and gender before occupying the accommodation. 9.3. The Accommodation is not responsible for any damage caused by the fault of the Guest. Damage to the property will be charged to the guest. 9.4. If you wish to book before 9:00 on the day of arrival, 50 percent of the previous night will be charged. 9.5. Due to the fact that there is a labrador kennel in the neighborhood, pets are NOT allowed to protect the labradors and their little ones. The guest is obliged to compensate the accommodation for any injuries caused by pets brought in without permission. 9.6. Smoking is not allowed in the accommodation or in the entire building. In the courtyard, between the outer and inner track, the Accommodation Provider provides a designated place for smoking.

10. Refusal to use the accommodation, termination of the contract.

10.1. The Accommodation has the right to terminate the contract and refuse to provide the service if the Guest
  1. non-performance payment obligation.2. the guest does not use the accommodation for its intended purpose 3. suffers from an infectious disease 4. under the influence of drugs 5. shows unacceptable, immoral, violent, incompatible conduct in the house and its surroundings. 6. for reasons beyond the control of the parties, known as Force Majeure (war, fire, flood, weather, power outage, strike) over which the party has no control

11. Guest Rights

  1. The Guest is entitled to the proper use of the Accommodation within the scope of services,2. The Guest is entitled to use the equipment and facilities of the accommodation. 3. The Guest, in case of competence, is entitled to the proper and careful use of the tiled stove, fireplace and garden grill in the guest house of the Service Provider. 3. In the event of any problems during your stay, the service provider can be reached by phone or in writing at patwest2021@yahoo.com to resolve the problem as soon as possible. 4. The Guest’s right to complain expires after leaving the accommodation.

12. Obligations of the Guest

12.1. The Guest is obliged to pay for the services by the date and in the manner specified in the Contract. 12.2. Ensure that children between the ages of 14 and 18 under their supervision are only supervised by an adult. 12.3. The guest is obliged to compensate the service provider for the damage caused by him or his attendant or by persons under his supervision.

13. Rights of the Service Provider

13.1. The Service Provider is entitled to retain the amount of 30% of the accommodation costs received for the accommodation service ordered and finalized by the Guest, but not used by the Guest, as set out in these GTC and the Booking and Cancellation Conditions. 13.1.2. The Service Provider has the right to 1-6. refusal or termination of the accommodation service in the case of the provisions of points.

14. Liability of the Service Provider

14.1 .. The Service Provider is obliged to investigate the guest’s complaint during his stay and take the necessary steps to deal with the problem. 14.2. The Service Provider is obliged to provide the Guest with telephone contact in order to resolve any problems or issues that may have arisen during their stay. 14.3. The Service Provider is not responsible for the electrical equipment imported by the guest, the guest is responsible for the damage caused by them. 14.4. The liability of the Service Provider does not extend to damages caused by the guest himself or to unavoidable damages outside the circle of guests. 14.5. The Service Provider is not responsible for personal belongings, valuables or cash left in the service provider’s public spaces or rooms. 14.6. The Service Provider is not responsible for valuables left in the Service Provider’s free, fenced parking lot.
  1. Payment and Cancellation Policy
15.1. The reservation is valid by accepting the Booking and Cancellation Conditions and the GTC, after paying 30% of the total accommodation fee in advance and confirming it. If the requested amount is not received by the specified deadline, the Service Provider’s obligation to offer and provide services will also be terminated. 15.2. Payment of 30% must be made by bank transfer. The remaining accommodation fee must be paid no later than 3 days before the booking. It is not possible to pay the accommodation fee in cash on site. If the occupation fails for any reason after the full amount has been paid, the full amount of the accommodation fee will be considered as a penalty. In this case, the reservation may be transferred after prior notice to the Service Provider. 15.3. Any costs associated with the transfer will be borne by the Contracting Guest.
  1. Privacy
16.1. The Service Provider considers the protection of personal data important and takes all security, technical and organizational measures that guarantee the security of the data, the guest data is stored only until the day of check-out. 16.2. In fulfilling its obligation under the Contract, the Service Provider is obliged to enforce the applicable legislation on the protection of personal data and the disclosure of data of public interest. Act in accordance with the provisions of the relevant data protection legislation on the right to information self-determination and the freedom of information. 16.3 In compliance with the legal changes of 2021, the Service Provider is obliged to read and upload the Guest ID card with the document reader or document reader software to the Guest Information Closed Database (VIZA) regardless of age and gender before occupying the accommodation. > 16.4. The guest acknowledges that the Service Provider is obliged by law to provide the requesting authority with data in accordance with the law. 16.5. The Service Provider publishes its privacy policy in a separate Privacy Statement on its website.
